1. Acceptance of Terms

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding contract between you ("User", "you", or "your") and CoupleZone ("we", "us", or "our"), governing your access to and use of the CoupleZone mobile application for Android, our cloud synchronization services, and related websites (collectively, the "Service").

BY DOWNLOADING, INSTALLING, REGISTERING FOR, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL, ACCESS, OR USE COUPLEZONE.

2. Eligibility & Age Restriction

You may use CoupleZone only if you meet the following legal eligibility criteria:

1. Age Requirement: You must be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is greater). CoupleZone is strictly intended for adult relationships.

2. Legal Capacity: You possess the full legal right, capacity, and authority to enter into this Agreement.

3. No Prior Prohibition: You have not previously been suspended, banned, or terminated from using CoupleZone for violating our policies or applicable laws.

If you are under 18 years old, you are strictly prohibited from creating an account or providing any personal data to CoupleZone.

3. Account Registration, Security & Consensual Pairing

A. Account Security

To access most features, you must register using an email address, password, or third-party authentication provider (e.g., Google Sign-In). You are solely responsible for:

  • Maintaining the confidentiality of your login credentials and security tokens.
  • All activities, communications, and data logged under your account.
  • Promptly notifying us at [[email protected]](mailto:[email protected]) if you suspect unauthorized access to your account.

    • B. Consensual Couple Pairing

    CoupleZone functions through consensual, one-on-one pair bonding between two partners:

  • **Affirmative Consent Required:** Pairing is executed solely through a unique, single-use, 6-character pairing code generated by one partner and manually entered by the other.
  • **Strict Prohibition Against Stalkerware & Surveillance:** You agree **never** to pair CoupleZone to another person's device without their explicit, informed knowledge and consent. Using CoupleZone to covertly track, monitor, or spy on a partner, spouse, or any third party is a material violation of these Terms and may constitute a criminal offense under applicable cyber laws.

    • 4. Break-Up Protection, Unpairing & Account Separation

    We recognize that interpersonal dynamics may change. You possess the sovereign and unilateral right to end your couple pairing at any time:

  • **Unilateral Killswitch:** Either partner can activate the **Break-Up Protection Killswitch** (`Profile > Privacy & Data Shield`) or tap "Unpair" without requiring mutual consent or approval from the other partner.
  • **Immediate Effect:** Activating Break-Up Protection immediately severs real-time synchronization, revokes the partner's access to shared calendars, tasks, notes, games, and cycle snapshots, and converts shared records into private, single-user views.
  • **No Liability for Disconnection:** CoupleZone disclaims any and all liability for relationship disputes, emotional distress, or lost data resulting from a partner’s decision to activate Break-Up Protection or disconnect.

    • 5. Medical Disclaimer for Period & Wellness Tracking

    **CRITICAL MEDICAL DISCLAIMER:**
    **CoupleZone is NOT a medical device, clinic, licensed physician, or healthcare provider.**
    The Period & Menstrual Cycle Tracking module, fertile window calculations, ovulation estimates, and related wellness tips are algorithmic approximations intended solely for personal lifestyle awareness and relationship communication.
    - **NOT FOR CONTRACEPTION:** CoupleZone MUST NEVER be relied upon as a method of birth control, natural family planning, or contraception.
    - **NOT MEDICAL ADVICE:** The Service does not provide medical diagnoses, treatment plans, or clinical evaluations.
    - Always seek the guidance of a qualified gynecologist, obstetrician, or healthcare provider regarding any reproductive, hormonal, or general health concerns. Never disregard professional medical advice because of information presented in CoupleZone.

    6. AI Companion & Relationship Inspiration Disclaimer

    CoupleZone includes optional artificial intelligence (AI) features powered by Google Gemini AI (such as date idea generators, communication suggestions, and Daily Spark prompts):

  • **Entertainment & Enrichment Only:** All AI-generated responses, tips, and communication frameworks are generated programmatically for creative inspiration and entertainment purposes only.
  • **Not Professional Counseling:** The AI features do **NOT** constitute licensed marriage counseling, relationship therapy, psychiatric evaluation, psychological treatment, or legal advice.
  • **No Liability for Interpersonal Outcomes:** You are solely responsible for your communication, decisions, and actions within your relationship. CoupleZone accepts no liability for relationship conflict, break-ups, or decisions made in reliance on AI-generated suggestions.

    • 7. User-Generated Content & Acceptable Use Policy

    A. Ownership of Your Content

    You retain full ownership of all text, to-dos, notes, photos, coupons, and check-ins you upload or create ("User Content"). By submitting User Content, you grant CoupleZone a worldwide, royalty-free, non-exclusive license solely to host, store, transfer, and display that content to you and your paired partner to operate the Service.

    B. Prohibited Conduct & Content Standards

    You agree that you will NOT use CoupleZone to:

    1. Harass or Harm: Stalk, threaten, abuse, harass, defame, bully, or intimidate your partner or any other individual.

    2. Non-Consensual Imagery: Upload, share, or store non-consensual intimate imagery (including revenge pornography), sexually explicit depictions involving minors, or content created without the consent of all depicted individuals.

    3. Unlawful Content: Post or transmit content that violates any local, state, national, or international law, or that infringes upon third-party intellectual property or privacy rights.

    4. Platform Abuse & Hacking: Reverse engineer, decompile, disassemble, or attempt to derive the source code of CoupleZone; bypass security protections or Row-Level Security rules; scrape data; or introduce viruses, trojans, worms, or malicious scripts.

    5. Commercial Exploitation: Resell, redistribute, or use CoupleZone for commercial advertising, spamming, or marketing purposes without our prior written consent.

    We reserve the right, but have no obligation, to investigate violations and suspend or permanently terminate accounts that violate this Acceptable Use Policy.

    8. Intellectual Property Rights

    All rights, titles, and interests in and to the CoupleZone application—including its source code, UI designs, claymorphic styling, animations, graphics, illustrations, trademarks, logos, audio assets, mini-games, and algorithmic methods—are the exclusive intellectual property of CoupleZone (Udit Narayan) and our licensors.

    Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use CoupleZone for your personal, non-commercial use on compatible Android devices that you own or control.

    9. Third-Party Services, Subscriptions & Advertisements

    Advertising: CoupleZone runs ads in the application. Google AdMob may serve banner or interstitial advertisements and process limited device and advertising information for delivery, measurement, and fraud prevention. Private notes, relationship content, photos, calendar data, and reproductive wellness data are not used for advertising.

  • **Third-Party Integrations:** The Service relies on third-party cloud infrastructure (e.g., Supabase, Google Firebase, Google Cloud). We are not responsible for downtime, data loss, or service disruptions caused by third-party infrastructure failures outside our reasonable control.
  • **Advertisements:** The free tier of CoupleZone may display third-party advertisements via Google AdMob. We do not endorse or assume responsibility for any products, services, or websites advertised by third parties.
  • **In-App Purchases & Subscriptions:** If you purchase optional premium features or digital goods, transactions are processed directly by Google Play Billing and are subject to Google Play’s Terms of Service and refund policies.
  • **Virtual Items (Love Coupons, Badges, Game Points):** Love Coupons and in-app game awards are simulated virtual relationship tokens. They have no monetary, cash, or real-world value and cannot be redeemed for fiat currency.

    • 10. Account Termination & Data Deletion

    A. Termination by You

    You may terminate your account and this Agreement at any time:

  • **In-App:** Go to `Profile > Privacy & Data Shield > Delete Account Permanently`. This immediately and irreversibly wipes your credentials, pairing, and stored relationship records.

    • B. Termination by CoupleZone

    We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, if:

  • You breach any provision of these Terms or our Acceptable Use Policy.
  • We are required to do so by applicable law, court order, or regulatory authority.
  • Continued operation poses a security, legal, or technical risk to other users or the Service.

    • Upon termination, all licenses granted to you herein immediately cease, and your right to access the Service terminates.

    11. Disclaimer of Warranties

    COUPLEZONE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

    TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, COUPLEZONE AND ITS AFFILIATES, OFFICERS, LICENSORS, AND DEVELOPERS DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE.
  • WARRANTIES THAT PUSH NOTIFICATIONS, REAL-TIME SYNC, OR CALENDAR REMINDERS WILL ALWAYS BE INSTANTANEOUS OR WITHOUT PACKET LOSS.
  • WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF CYCLE PREDICTIONS, FERTILE WINDOWS, OR AI-GENERATED RELATIONSHIP RECOMMENDATIONS.

    • 12. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COUPLEZONE, ITS FOUNDERS, DIRECTORS, AFFILIATES, OR LICENSORS BE LIABLE FOR:

    1. INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;

    2. PERSONAL INJURY, EMOTIONAL DISTRESS, OR RELATIONSHIP DISSOLUTION;

    3. LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;

    ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE;
  • ANY CONDUCT OR CONTENT OF YOUR PAIRED PARTNER OR ANY THIRD PARTY ON THE SERVICE;
  • UNILATERAL ACTIVATION OF BREAK-UP PROTECTION OR UNPAIRING;
  • RELIANCE ON CYCLE ESTIMATES, AI SUGGESTIONS, OR CALENDAR NOTIFICATIONS; OR
  • UNAUTHORIZED ACCESS, ALTERATION, OR TRANSMISSION OF YOUR CONTENT.

    • IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO COUPLEZONE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE THOUSAND INDIAN RUPEES (INR ₹1,000) OR FIFTY UNITED STATES DOLLARS (USD $50).

    13. Indemnification

    You agree to defend, indemnify, and hold harmless CoupleZone, its creators, affiliates, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or legal fees arising out of or relating to:

  • Your violation of these Terms or our Privacy Policy;
  • Your User Content;
  • Your non-consensual pairing or misuse of another individual's device; or
  • Your violation of any rights of another person or applicable law.

    • 14. Dispute Resolution & Governing Law

    A. Informal Resolution First

    Before initiating formal legal proceedings, you and CoupleZone agree to attempt to resolve any dispute, claim, or controversy arising out of these Terms through good-faith informal negotiations by emailing [email protected] for a period of at least thirty (30) business days.

    B. Governing Law

    These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

    C. Exclusive Jurisdiction

    Subject to the informal resolution process, you and CoupleZone irrevocably submit to the exclusive jurisdiction of the competent courts located in Ranchi, Jharkhand, India to resolve any legal action, suit, or proceeding arising under or related to these Terms.

    D. Class Action Waiver

    WHERE PERMISSIBLE UNDER APPLICABLE LAW, ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

    15. Severability & Entire Agreement

  • **Severability:** If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and will not affect the validity and enforceability of any remaining provisions.
  • **Entire Agreement:** These Terms, together with our [Privacy Policy](PRIVACY_POLICY.md), constitute the entire agreement between you and CoupleZone regarding the Service, superseding all prior oral or written agreements.
  • **No Waiver:** Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

    • 16. Changes to These Terms

    We reserve the right to revise or modify these Terms at any time at our sole discretion. If we make material modifications, we will notify you through an in-app announcement, push notification, or updated date stamp at least fourteen (14) days prior to the effective date.

    Your continued access to or use of CoupleZone after any revisions become effective constitutes your binding acceptance of the updated Terms. If you do not agree to the new terms, you must discontinue using CoupleZone and delete your account.
